General terms and conditions

Effective as of 29 June 2021.

1. General

1.1 These terms and conditions apply to any use of Zliide Technologies ApS’ application for iOS and Android (hereinafter referred to as the “Zliide app”) and Zliide Technologies ApS’ website shopping.zliide.com (hereinafter referred to as the “Zliide web”). The owner of the Zliide app and Zliide web is Zliide Technologies ApS, CVR no.: DK37556319.

1.2 By downloading and installing the Zliide app you accept these terms and conditions.

1.3 By purchasing or creating a user on the Zliide web you accept these terms and conditions.

1.4 The purpose of the Zliide app is that you can complete a purchase of products directly through the application in the physical stores (hereinafter referred to as “the Store”) that use Zliide as a service. You can also “remotely” (outside the physical store’s place of business) purchase all products from stores that use Zliide directly in the Zliide app.

1.5 The purpose of the Zliide web is that you can “remotely” (outside the physical store’s place of business) purchase all products from stores that use Zliide.

2. Terms of use

2.1 The first time you use the Zliide app you must log in via your Facebook login information, sign in with Apple, or you can enter your e-mail address and make a password of your own choice. You can also press “skip” and use the Zliide app via guest access.

2.2 The first time you use the Zliide web, you must accept our Cookie Policy to be able to use the Zliide web. If you want to complete a purchase on the Zliide web, you must also accept our Terms and Conditions and Privacy Policy.

2.3 You have a duty to ensure at all times that the information on Facebook as well as your manually entered information on your Zliide profile is correct and up to date.

2.4 In order to use the Zliide app and the Zliide web to complete a purchase, it is also a condition that you use an approved payment/debit card hereto. If you use MobilePay, you are encouraged to read the terms of use for MobilePay, as the terms of use may affect the use of Zliide.

3. Personal information

3.1 Zliide collects and processes personal information about you in connection with your user creation and behavior in the Zliide app, behavior on the Zliide web and for marketing purposes. We encourage you to read more about this in our Privacy Policy.

4. How does Zliide work?

4.1 The Zliide app is an application that allows you to complete a purchase directly on your mobile device. The Zliide app can only be used in the Stores with which Zliide has entered into an agreement. In the application you can find more information about which Stores are using Zliide.

4.2 The Zliide web is a website that allows you to complete a purchase. The Zliide web can only be used in the Stores with which Zliide has entered into an agreement. On the Zliide web you can find more information about which stores are using Zliide.

4.3 An alarm tag has been mounted on each product in the Store. When you press the alarm tag and hold your mobile device with the Zliide app open close to it, you will see information about the product on your mobile device. This is only possible if you have activated Bluetooth on your mobile device. Once the product is displayed on your mobile device, you can complete the purchase by using MobilePay, payment/debit card or in time another payment option. When the payment is completed, the alarm tag will detect this. The alarm tag then unlocks, and you will now be able to remove the alarm tag from the purchased product. You will receive a digital receipt, which will be saved on your profile under “Receipts”.

4.4 The store’s products on which an alarm tag has been mounted will be possible to buy as a “distance purchase” (from outside the store’s physical place of business) directly through the Zliide app and the Zliide web. This is done by adding one or more products to your basket/shopping cart in the app, after which you enter your name, address, postcode and phone number. You can then complete the purchase using MobilePay, payment/debit card or in time another payment option. Once the purchase is completed an order request will be sent to the store(s) that sells the product(s), after which they must accept or reject the order. If accepted, the order will be shipped from the store(s) to your delivery address and if rejected, the reservation of the purchase amount will be canceled. If you have placed an order with products from different stores and one of the stores cancels their part of your order, you will still receive the remaining part of the order that the other store must deliver. Of course, you will only pay for the part of the order that the store(s) accept.

4.5 If you have scanned a product but have not completed the purchase in the Store, Zliide saves the information about the product. This is done for the purpose that you can complete the purchase outside the Store’s physical place of business and subsequently pick up the order at the Store or have it sent to your address.

4.6 If you make a purchase outside the Store’s physical place of business through the Zliide app or the Zliide web, Zliide only acts as an intermediary of the order between you and the Store(s) that sells the product(s), thus Zliide is not a party to the agreement. You will always be able to see who sells the product(s) to you in the Zliide app. You can contact Zliide at any time to find out who your contracting party is.

5. Right of cancellation

5.1 The right of cancellation pursuant to the Danish Consumer Protection Act §18(1) does not apply if the purchase is completed at the Store’s physical place of business, as the purchase does not take place by distance selling.

5.2 If the purchase is completed as stated in section 4.3 and/or section 4.4 – that is the purchase is completed outside the Store’s physical place of business – then the Danish Consumer Protection Act’s rules regarding right of cancellation apply, cf. below.

5.3 Pursuant to the Danish Consumer Protection Act, you have the right to cancel and return your purchase within 14 days after you have received the product(s). The 14-day period starts the day you receive the product(s) in your physical possession.

5.4 If you wish to exercise your right of cancellation, you must explicitly inform the Store(s) that you wish to cancel the purchase before the expiry of the cancellation period.

5.5 The message must be sent to the Store(s) that delivered the product(s). You can find information about the Store(s) as well as the Store’s contact information on the enclosed packing and return note. You can also use the standard cancellation form, which can be found in the Zliide app or on the Zliide web.

5.6 If the Store or Zliide receives the cancellation in accordance with this provision later than 14 days after you have received the product(s) in your physical possession, the right of cancellation lapses.

5.7 The product(s) must be sent no later than 14 days after the date on which you notified the Store(s) that you wish to exercise your right of cancellation. The product(s) must be sent using the enclosed return stamp.

5.8 The costs associated with returning the product(s) are free for you. In case the product(s) is accidentally lost or damaged during the transport, you bear the risk hereof.

5.9 You cannot return the product(s) by COD (cash on delivery) or to a parcel shop. The product(s) must be sent using the enclosed return stamp, on which the sender’s name and address are stated.

5.10 You are liable for any deterioration in the value of the product(s) if the commissioning is beyond what is necessary to determine the nature and properties of the product(s) and as part of testing the product(s). However, the right of cancellation under this provision is sustained so that the Store is entitled to set off the deterioration in the amount repaid.

5.11 With regard to sealed goods, which for health protection or hygienic reasons are not suitable for return and where the seal has been broken, the right of cancellation does not apply cf. the Danish Consumer Protection Act §18 (2, no. 5). The same applies to sealed audio or video recordings or computer software and where you have broken the seal.

5.12 When the Store receives the returned product(s), it will be examined, and you will receive a refund of the amount you paid for the product(s) within 14 days. In the event that the Store finds any deterioration of the product this will be set off in the amount repaid.

6. System requirements

6.1 The Zliide app is compatible with iOS 11 or newer and Android 6 or newer.

6.2 The Zliide web supports most major browsers and devices. However, full functionality is only ensured in the latest stable versions of Chrome, Safari, Edge, and Firefox.

6.3 You must have Bluetooth enabled to use Zliide in a Store.

7. Responsibility, abuse and security

7.1 It is your own responsibility to ensure that others do not have free access to your mobile device. Zliide recommends that you regularly change your password and take the necessary security measures to avoid abuse. You should not disclose your password to others.

7.2 Zliide is not responsible for any damages and losses that may occur if you lose your mobile device or that a third party misuses your Zliide user.

7.3 You are responsible for checking that the purchase amount is correct.

7.4 Zliide is not responsible for any flaws and deficiencies of the goods or services provided by the Store. Therefore, any complaints must be directly addressed to the Store where you purchased the product(s).

8. Changes

8.1 You will be notified via the Zliide application or the Zliide web if we change your conditions. Zliide may change them without notice if the changes are in your favor. If Zliide imposes obligations on you or the like, the changes will be notified with two months. If the changes imply that you must give a new consent, you will be asked to accept the changed conditions. You can read the terms and conditions at our website www.zliide.com at any time. If you do not wish to be subject to new conditions, please contact Zliide at the contact information provided in section 9.

10.Complaints

10.1 Any complaints can be sent to Zliide. We will respond and process the complaint as soon as possible. If an amicable settlement is not reached, a complaint can be lodged with the following;

11. Choice of law and venue

11.1 Any dispute arising from this agreement is subject to Danish law and must be settled by the court of Aalborg.
